Abolition of Double Jeopardy Rule

Postby Trina » Thu Aug 02, 2007 2:43 pm

‘Double jeopardy’ means being tried twice for the same offence. The ‘double jeopardy’ rule means that an individual cannot be tried again for the same offence if acquitted. Should the rule be scrapped?

I always thought it was an American thing and not English, coming from back when we used to own the US.

That's silly. New evidence could always turn up later, so they should definitely allow reopening of cases.

Yes but if could be wrong evidence and you could be in and out of court all your life

at the end of the once you walk from court you are a free man or woman

i dont think anyother way would really work as you would never really be free

Don't think so. Evidence that could genuinely have a bearing on the case won't be popping up every other day, and if it did, it must be taken to court.

On the other hand, if someone is deliberately concocting evidence to harass you, there are laws to punish such false evidence.

So you would be free, unless something genuinely important came along.
